The mall’s value fell from $427 million to $112 million
Deutsche Bank National Trust Co., acting for the bondholders of a commercial mortgage-backed securities trust, has sued in Broward County Circuit Court to foreclose on Pembroke Lakes Mall in Pembroke Pines, saying the borrower, Pembroke Lakes Mall LLC, failed to repay its $260 million loan at its March 2025 maturity. An appraisal dated April 17, 2026 values the mall at $112 million, down 73.8% from the $427 million appraised when the loan closed in 2013, KBRA says (Bisnow; The Real Deal; KBRA).
The South Florida Business Journal, as Connect CRE summarized it, said the suit was filed Sept. 30. According to the suit, the borrower owed $263.8 million in principal, interest and default interest as of Sept. 1, and the lender says it sent notices of default in April 2025 and April 2026. It asks the court to appoint Carmen Spinoso of Spinoso Real Estate Group as receiver (Connect CRE; Bisnow; The Real Deal).
Your stake: if you pay property tax in Pembroke Pines, the main mall parcel is on the county’s 2026 roll at a market value of about $108.4 million, up from $96.4 million, and paid about $2.19 million in property tax for 2025 (Broward County Property Appraiser).
The loss falls on the bond trust
The loan backs a single-asset bond deal, GSMS 2013-PEMB, secured by a 535,446-square-foot part of the 1.1 million-square-foot mall, and it is non-recourse. KBRA estimates an implied loss of about $149 million to the trust. Class A bondholders receive about 71% of their monthly interest, and the other rated classes have received none since September 2025. The loan moved to the special servicer on March 14, 2025; Brookfield asked for a three-year extension, which was not approved (KBRA).
The mall earns more than its debt service; the problem is the principal. The Real Deal reports $8.3 million in net operating income in the first half of the year against $3.9 million in required debt service, but the loan’s 3.6% rate is far below today’s, so refinancing could be hard. Morningstar put occupancy at 95% in September 2024 and said cash flow had fallen 30%; tenants include H&M, American Eagle, AMC Theatres and Dillard’s (The Real Deal; Bisnow; Commercial Observer).
Brookfield owns it, but was not named
The owner is BGRE, formerly Brookfield Properties, which was not named in the suit, The Real Deal reports; Brookfield is a Toronto-based investment firm headed by Bruce Flatt, and KBRA names Brookfield Property Partners as the loan’s sponsor. County records list the main mall parcel at 11401 Pines Blvd. under Pembroke Lakes Mall Ltd and the former Sears site under Pembroke Lakes Mall LLC, the defendant, both in care of Brookfield Properties Retail. Goldman Sachs originated the loan in 2013, Bisnow reports, and BGRE, then Brookfield Properties, acquired the mall in 2018 through its purchase of General Growth Properties (The Real Deal; KBRA; Broward County Property Appraiser; Bisnow).
Their side: BGRE, Deutsche Bank and the lender’s attorney, Marx Calderón of Polsinelli, did not respond to Bisnow’s requests for comment (Bisnow).
What’s next is the receiver request
No ruling or receiver appointment has been reported. KBRA says receivership has been initiated while other resolution options are considered. Malls are a wider problem: Morningstar tracks 423 commercial mortgage-backed loans tied to 182 malls, totaling $42 billion, with $8.7 billion of them in special servicing (KBRA; Bisnow).
